      The Barrister Course - Attendee

Engaged in a variety of criminally orientated tasks providing insight into the workings of criminal barristers, including: • Assessing client information in order to produce a plea in mitigation, identifying and presenting any mitigating factors which may be considered to avail our client (fictitious) of the summary offence of stealing from a local supermarket. Identifiable factors included the clients financial struggles following his mother’s redundancy and ongoing battle with depression, his consistent efforts with job applications, and his father’s recent passing leaving the family in a vulnerable position.• A secondary task requiring the group to assess the following question: “if a seriously ill person such as Mrs Mann asks for help to die, should the person who assists them be held responsible for their death?” This question facilitated a critical discussion involving questions such as ‘is the relationship between the ill person and their killer important?’ • A final task involving a similar structure of analysing the case of R v Martin [2002] surrounding the issue of Self Defence before answering the following question: “In what ways did Tony Martin exceed “reasonable force?” This discussion allowed us to contextualise what is meant by “reasonable force” before using our knowledge to consider follow up questions such as ‘was his position when firing the shot relevant?’ Show less

An immersive pro bono experience operating at the University of York Baroness Hale Legal Clinic. In developing a practical legal skillset, we engaged in various activities including: Familiarisation with new Legal Software Systems: • Introduced to a confidential legal software system ‘Clio.’ Following comprehensive training with the Legal Clinic administrator, we were able to effectively manage and meticulously draft legal documents which were organised and stored within our online case files. The organisation of physical case files: • In the handling of our first client case, we integrated the use of online legal databases with physical case files stored within the clinic. This required the fusion of technological and physical organisation, all while maintaining the confidentiality of the case. We achieved this by storing every document sensitively and in accordance with Clinic policies and external regulations. Direct Client Contact: • We composed interview plans and conducted client interviews to gather crucial facts for our legal research and advice. This required using various questioning techniques and building a strong rapport with client(s).Legal Drafting:• Under the guidance of our legal supervisor, we were able to develop our drafting skills. Tasks involved the creation of diverse document templates, such as Post Interview letter and Advice Letters. In this process, we had to consider multiple factors, including the use of plain language for accessibility, striking the right balance between detail and practical legal advice whilst also ensuring a cohesive, digestible structure. Legal Research: • The client centred approach of this module expanded upon our theoretical legal research abilities by developing a pragmatic approach which was both accessible yet detailed and applied directly to the client’s situation.
