Introduced to the positive duty on public authorities and service providers to provide positive reasonable adjustments for those that they may be negatively impacted by their policies. Current circumstances, have opened potential discrimination cases for a large group of people, especially surrounding redundancies. Moreover, introduced to the scope of the Equality Act, the protected characteristics within it and the questions to ask and think about when suspecting a possible discrimination case. Show less This workshop highlighted the importance of the case Arkin v Marshall [2020] especially when it comes to what parties can do during the stay period. If parties have an agreement to continue to comply with the Practice Directions during the stay, i.e. disclosure, building a defence etc. parties cannot apply to the court to state that one party has not complied, once the stay is lifted, parties that did not comply could face adverse repercussions such as an unfavourable costs order or less time to prepare.
