    • Mr.Ram Jethmalani, Senior Advocate, Supreme Court of India

      Feb 2015 - Mar 2015
      Legal Intern

In this period of internship, my learning was emphasized on process of Supreme Court. Working with the legend in itself was a learning process as one can learn 10 things out of Ram sir by observing him for an hour. In first week, I worked on two cases, first among them in itself was a remarkable case and a practical experience for me of a Mandamus Writ. It was a writ being filed in Hon'ble SC on behalf of CIGVA(Center For Integrity, Governance & Training in Vigilance Administration) in violation of Article 14 challenging the interpretation of Section 3(3) of CVC Act'2003. Second case of the week was elongated case of "Standard Chartered V. Canara Bank", where I attended a prolong conferences for whole week and the arguments which went continuously for two long days. The case was regarding the fraudulent issuance of bonds by the broker. Following the week, the cases were more peculiar and interesting. I attended and researched in the case of "Sushila Yadav V. Atul Chaudhary", where there was the property dispute where the application of Easement Act'1882 was used. An another case of "HC of AP V. Nirmala", where the suspension of the Judge of the district court of Andhra Pradesh on the grounds of corruption, where High Court granted relief, was again challenged by the Prosecutor of HC. In the mid of it, I was also fortunate enough to get an opportunity to attend the proceeding of the case of "Teesta Setalvad V. State of Gujarat", where the bail application was moved on behalf of the petitioner in the 2002 Misappropriation of Gujarat Riot fund. I also researched elaborately on the law point of suspension of sentence awarded by Lower court in the case of Murder and Conspiracy where the accused has stayed behind bars for two years, when the requirement is of at least three years in the cases of heinous crime and eventually got relief. This was in the infamous assassination case of Railway Minister L.N.Mishra in 1975, "Ranjan Dwivedi & ors. V. CBI. Show less

      Associate

During my association with Mr.Kirti Uppal, Sr.Adv., I worked on variety of matters ranging from constitutional matters to original civil side and criminal. I learnt court articulations, craftsmanship, research, drafting and briefing during this period of my juniorship. I worked on many special statutes like Delhi Agricultural Cattle Preservation Act' 1994, Customs Act, SARFAESI, etc. During my juniorship, I also worked on cases in which new law was laid down and those judgments were reported in the Law Journals. While working with Mr.Uppal, some of the landmarks cases I worked on were Ashok Bhadauria vs State, Crl.Rev.P.274/2007, where the single bench of the Hon’ble High Court of Delhi while remanding back the matter held that the Court at the time of framing the charge is required to discuss the material on the record to show its application of mind to reach to the conclusion of sufficiency of material to frame the charge. In Directorate of Revenue Intelligence vs. Dr.Bernd Augustine, Crl.M.C.4861/2016, where the DRI had challenged the order of Learned Metropolitan Magistrate granting the permission to the German national to travel to Germany who was an accused in the FIR where allegations of recovery of antique articles from his possession was made. The single bench of the Hon’ble High Court of Delhi, while dismissing the petition of the DRI, permitted the German national to travel to Germany on the guarantee of the German Counsellor and Consul. In Sushil Ice Factory & Cold Storage Pvt. Ltd. and Anr. vs GNCTD, W.P.(C) 2480/2017, the single bench of Hon’ble High Court of Delhi while de-sealing the premise of the Petitioner held that there is no provision in the Delhi Cattle Preservation Act’ 1994 to seal the premise even in the case where the meat is found to be suspicious.
